PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING ASTRALBOOKING.

1. Agreement to Terms

By accessing, downloading, installing, or using AstralBooking (the "Plugin"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to abide by the above, please do not use this service.

These Terms apply to all users of the Plugin, including but not limited to end users, customers, vendors, and content contributors. Webtex-IT ("we," "us," "our," or "Company") reserves the right to modify these Terms at any time. Your continued use of the Plugin following any changes constitutes your acceptance of the new Terms.

2. Use License

Grant of License

Webtex-IT grants you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use AstralBooking on your WordPress website(s)
• Access and utilize the Plugin's features and functionality
• Modify the Plugin's appearance to match your website (for free version)

Restrictions

You agree NOT to:

• Sell, rent, lease, or transfer the Plugin or any of its components
• Copy, modify, or create derivative works of the Plugin
• Reverse engineer, decompile, or otherwise attempt to derive source code
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the Plugin for unlawful purposes or to violate any laws or regulations
• Use the Plugin to send spam, malware, or other harmful content
• Attempt to gain unauthorized access to the Plugin or its servers
• Resell or redistribute the Plugin without explicit permission

3. Intellectual Property Rights

Ownership

AstralBooking and all its components, including code, design, documentation, and trademarks, are the exclusive intellectual property of Webtex-IT. You are granted a license to use the Plugin, but you do not own it. All rights not explicitly granted in these Terms are reserved.

Your Content

You retain all ownership rights to any content you create or upload using AstralBooking (such as appointment data, customer information, and custom forms). However, you grant Webtex-IT a worldwide, royalty-free license to use your content as necessary to provide the Plugin's services and improve our offerings.

4. Free Version vs. Pro Version

Free Version

The free version of AstralBooking is provided "as is" without warranty. You may use it indefinitely at no cost, subject to these Terms and our Privacy Policy.

Pro Version

The Pro version requires an annual subscription fee of $49 USD per year. Payment terms and conditions:

• Subscriptions are billed annually
• Renewal occurs automatically at the end of each year unless cancelled
• You can cancel your subscription at any time
• Refunds are available within 30 days of purchase if you are not satisfied
• All sales are final after the 30-day refund period

Feature Changes

Webtex-IT reserves the right to add, remove, or modify features in both the free and Pro versions. We will provide notice of significant changes to paid features.

5. Payment and Billing

Payment Processing

Pro version payments are processed securely through third-party payment processors (e.g., Stripe, PayPal). You agree to provide accurate payment information and maintain current payment details.

Billing Errors

If you notice a billing error, contact us at support@webtex-it.com within 30 days with supporting documentation.

No Refunds After 30 Days

Refund requests must be submitted within 30 days of purchase. After this period, all sales are final and non-refundable.

6. User Responsibilities

Lawful Use

You agree to use AstralBooking only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use and enjoyment of the Plugin. Prohibited behavior includes:

• Collecting or tracking personal information without consent
• Harassing, bullying, or defaming any person
• Using the Plugin for fraudulent or deceptive purposes
• Violating any applicable laws or regulations
• Creating spam or unsolicited communications

Data Accuracy

You are responsible for ensuring that all data you enter into AstralBooking (customer information, appointments, pricing, etc.) is accurate and up to date. Webtex-IT is not responsible for errors or inaccuracies in your data.

Backup and Data Loss

While we implement reasonable security measures, you are responsible for maintaining backups of your data. Webtex-IT is not liable for any data loss due to technical failures, natural disasters, or other unforeseen events.

7. Warranty Disclaimer

As-Is Provision

AstralBooking is provided "AS IS" without warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Service Availability

We do not warrant that:

• The Plugin will be uninterrupted or error-free
• Defects will be corrected
• The Plugin will be compatible with all hosting environments
• Your specific business goals will be achieved

Third-Party Services

AstralBooking integrates with third-party services (e.g., email providers, payment processors, calendar services). We are not responsible for the performance, availability, or security of these third-party services.

8. Limitation of Liability

No Consequential Damages

In no event shall Webtex-IT be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if advised of the possibility of such damages.

Liability Cap

Our total liability to you for all claims arising from or related to the Plugin shall not exceed the amount you paid for the Pro version in the past 12 months, or $100 USD if you used only the free version.

Exceptions

These limitations do not apply to:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Violations of consumer protection laws

9. Termination

Termination by You

You may cease using AstralBooking at any time. If you are a Pro subscriber, you may cancel your subscription anytime. Upon cancellation, you will not be charged for future billing cycles.

Termination by Us

We may terminate your license or access to the Plugin if you:

• Violate any terms in this Agreement
• Engage in fraudulent or illegal activity
• Use the Plugin to harm others or distribute malware
• Repeatedly violate our policies

Termination will be effective immediately upon notice. Upon termination, your right to use the Plugin ceases, and you must remove it from your website.

10. Support and Maintenance

Free Version Support

Free version users have access to:

• Documentation and knowledge base
• Community forums
• Email support (response time: 3-5 business days)

Pro Version Support

Pro version users receive:

• All free version support
• Priority email support (response time: 1-2 business days)
• Direct support contact

Support Limitations

We are not responsible for:

• Support for custom code modifications
• Issues caused by third-party themes or plugins
• Hosting or server configuration issues
• Data recovery from deleted files

11. Updates and Changes

Software Updates

We may release updates to AstralBooking to improve functionality, fix bugs, or address security issues. You are responsible for keeping your Plugin updated. While we strive to maintain compatibility, updates may occasionally break existing functionality.

Breaking Changes

When possible, we provide advance notice of breaking changes. However, we cannot guarantee full compatibility with all hosting configurations or customizations.

12. Prohibited Conduct

You agree that you will NOT use AstralBooking to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit viruses, malware, or other harmful code
• Engage in harassment, stalking, or threatening behavior
• Collect personal data without proper consent
• Send unsolicited commercial communications or spam
• Conduct automated scraping or data harvesting
• Attempt to gain unauthorized access to systems
• Engage in any form of fraud or deception

13. Indemnification

You agree to defend, indemnify, and hold harmless Webtex-IT, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms
• Your violation of any law or regulation
• Your use of the Plugin in an unauthorized manner
• Your infringement of any third-party rights
• Content you create or upload using the Plugin

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United Kingdom, and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales. If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable.

15. Dispute Resolution

Informal Resolution

Before initiating formal proceedings, you agree to attempt to resolve any disputes informally by contacting support@webtex-it.com. We will attempt to resolve the issue within 30 days.

Formal Proceedings

If informal resolution is unsuccessful, disputes shall be resolved in the courts of England and Wales, and you consent to the jurisdiction and venue of such courts.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Webtex-IT regarding your use of AstralBooking. These Terms supersede all prior agreements, understandings, and negotiations, whether oral or written.
